MR. BALDMAN TRIVIA

TERMS OF USE

These Terms of Use (“Terms”) govern your access to and use of the Mr. Baldman Trivia mobile application, related services, online features, and content (collectively, the “App”).

The App is operated by Jonathon Walters under the Mr. Baldman brand (“Mr. Baldman,” “we,” “us,” or “our”).

By downloading, accessing, purchasing through, or using the App, you agree to these Terms. If you do not agree to these Terms, do not use the App.
 

1. ABOUT MR. BALDMAN TRIVIA

Mr. Baldman Trivia is an entertainment and trivia application that may include features such as:
 

• Trivia questions across multiple subjects and difficulty levels
• Different trivia game modes
• Daily challenges
• Player statistics, experience points, streaks, achievements, and progress
• Trivia packs and premium content
• Trivia Tokens and other virtual items
• Leaderboards
• Player profiles
• Friends and friend requests
• Player-versus-player or duel features
• Purchase restoration and player recovery features
• Baldman Ultimate subscription features
• Other game modes, content, social features, and services added over time

Features may vary by platform, device, geographic region, App version, or account status.
 

2. ENTERTAINMENT PURPOSES

Mr. Baldman Trivia is provided for entertainment purposes.

Although we make reasonable efforts to provide accurate trivia questions, answers, statistics, categories, and other content, we do not guarantee that every item will be error-free, complete, current, or free from interpretation or dispute.

Trivia results, rankings, achievements, statistics, scores, and other App information should not be relied upon for professional, educational, medical, legal, financial, or other important decisions.
 

3. LICENSE TO USE THE APP

Subject to these Terms and the applicable terms of the app store through which you obtained the App, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Mr. Baldman Trivia for your personal, non-commercial use.

You may not:

• Copy, reproduce, distribute, sell, sublicense, or commercially exploit the App or its content without authorization
• Reverse engineer, decompile, modify, circumvent, or attempt to gain unauthorized access to the App or its systems
• Use automated systems, bots, scripts, scraping tools, or similar methods to interact with the App
• Manipulate scores, leaderboards, achievements, purchases, Trivia Tokens, statistics, or game results
• Exploit bugs, vulnerabilities, or unintended App behavior to obtain an unfair advantage
• Interfere with the operation or security of the App or related services
 

4. PLAYER NAMES, PROFILES, FRIENDS, AND SOCIAL FEATURES

Certain features may allow you to select a player name, appear on leaderboards, search for other players, send or receive friend requests, participate in duels, or otherwise interact with other users.

You are responsible for the player name and information you choose to display.

You may not use player names, profile information, or other features to:

• Harass, threaten, impersonate, or abuse another person
• Use hateful, obscene, sexually explicit, discriminatory, or seriously offensive content
• Impersonate Mr. Baldman, App staff, another player, company, or public figure
• Advertise, spam, scam, solicit, or distribute malicious content
• Violate another person's privacy or intellectual property rights
• Attempt to evade moderation or enforcement measures

We may remove, restrict, rename, block, or disable player profiles or access to social features when reasonably necessary to protect the App, its users, or our services.
 

5. PLAYER PROGRESS AND DATA

The App may store certain gameplay information locally on your device and may also use online services for features such as leaderboards, friends, purchases, player recovery, synchronization, or other functionality.

Depending on the version and platform, player information may include items such as:

• Trivia progress
• Trivia Tokens
• Experience points and levels
• Achievements
• Purchased or unlocked trivia packs
• Statistics
• Friends or social relationships
• Leaderboard information
• Subscription status
• Other game-related information

You are responsible for maintaining appropriate access to your device and any Apple, Google, or other account used with App Store services or recovery features.

Although we take reasonable steps to maintain App services and player information, we cannot guarantee that data will never be lost, corrupted, delayed, unavailable, or affected by circumstances outside our control.
 

6. BALDMAN ULTIMATE AUTO-RENEWABLE SUBSCRIPTIONS

Mr. Baldman Trivia may offer an auto-renewable premium subscription called “Baldman Ultimate.”

The specific subscription options, subscription duration, price, billing period, included features, and any promotional offers will be displayed within the App before you complete a purchase.

Baldman Ultimate may provide access to premium trivia content, trivia packs, features, or other benefits described in the App at the time of purchase.

Subscriptions are processed through the applicable app store and are associated with your app-store account.
 

AUTO-RENEWAL

Baldman Ultimate is an auto-renewable subscription.

Your subscription will automatically renew at the end of each subscription period unless you cancel it through your app-store account before the renewal occurs.

Your app-store account will be charged according to the price and billing period presented to you when purchasing or renewing the subscription.

Pricing may vary by country, currency, platform, applicable taxes, and changes permitted by the applicable app store.
 

CANCELLATION

You may cancel your subscription through the subscription-management settings associated with your Apple App Store or Google Play account, as applicable.

Deleting the App does not automatically cancel an active subscription.

Cancellation generally stops future renewals. Unless otherwise required by law or the applicable app store's policies, cancellation does not retroactively refund the current subscription period.
 

RESTORE PURCHASES

Where supported, the App provides functionality to restore eligible purchases or subscription access associated with your app-store account.
 

SUBSCRIPTION CHANGES

We may add, remove, modify, or reorganize premium features over time as the App evolves, provided that we comply with applicable law and app-store requirements.
 

7. TRIVIA TOKENS AND OTHER VIRTUAL ITEMS

The App may allow users to purchase or earn virtual items known as Trivia Tokens.

Trivia Tokens may be used for eligible in-app features described within the App.

Trivia Tokens:

• Are digital items intended solely for use within Mr. Baldman Trivia
• Have no cash value outside the App
• Are not legal currency
• Cannot be redeemed for cash
• Cannot be transferred, sold, traded, or exchanged outside functionality expressly provided by the App
• May not be used for gambling, wagering, or obtaining real-world money or prizes unless a separate feature explicitly states otherwise and is legally permitted

The number of Trivia Tokens required for particular features may change as the App is updated.

Purchased Trivia Tokens and other digital items are subject to the payment, refund, and purchase policies of the app store through which the transaction was completed.
 

8. IN-APP PURCHASES

The App may offer subscriptions, Trivia Tokens, trivia packs, premium content, or other digital products.

Prices and purchase terms are displayed before purchase.

Payments are processed by the applicable app store, not directly by Mr. Baldman Trivia.

We do not receive or store your complete payment card information when purchases are processed through Apple or Google.

Refund requests for purchases processed by an app store are generally handled according to that app store's refund policies and applicable law.
 

9. LEADERBOARDS AND COMPETITIVE FEATURES

The App may include leaderboards, rankings, statistics, challenges, duels, and other competitive features.

Leaderboard placement and game statistics may change as additional games are played or systems are updated.

We may correct scores, remove invalid results, reset affected statistics, or take other reasonable action when we determine that results were caused by:

• Cheating
• Software manipulation
• Exploitation of a bug
• Automated gameplay
• Fraudulent activity
• Technical errors
• Other behavior that compromises the fairness or integrity of the App
 

10. ACCEPTABLE USE

You agree not to use the App in a manner that:

• Violates applicable law
• Harms or attempts to harm another person
• Disrupts App servers or services
• Attempts to gain unauthorized access to another player's information
• Circumvents purchasing or subscription systems
• Falsifies purchases or subscription status
• Manipulates gameplay, leaderboards, or statistics
• Distributes malware or harmful code
• Infringes copyright, trademark, privacy, publicity, or other rights
• Uses the App for fraudulent or deceptive purposes

We reserve the right to restrict or terminate access when reasonably necessary to enforce these Terms or protect users and App services.
 

11. INTELLECTUAL PROPERTY

The App and its original content, branding, graphics, interface designs, software, game systems, logos, text, compilations, and other materials are owned by or licensed to Mr. Baldman and are protected by applicable intellectual property laws.

“Mr. Baldman,” “Mr. Baldman Trivia,” related branding, logos, graphics, and original App materials may not be reproduced or commercially used without permission.

References to third-party artists, songs, movies, television programs, brands, historical events, public figures, products, or other subjects may appear as part of trivia content. Such third-party names and trademarks remain the property of their respective owners.

Unless expressly stated otherwise, the App is not affiliated with, endorsed by, sponsored by, or officially connected with those third parties.
 

12. THIRD-PARTY SERVICES

The App may rely on or interact with third-party services, including app stores, operating-system services, authentication providers, cloud services, payment systems, analytics services, or external websites.

Your use of third-party services may also be governed by the terms and privacy policies of those providers.

You agree to comply with applicable third-party terms when using the App.

We are not responsible for interruptions or changes caused solely by third-party services outside our reasonable control.
 

13. APP AVAILABILITY AND CHANGES

We may update, improve, modify, suspend, replace, or discontinue portions of the App from time to time.

We do not guarantee that:

• The App will always be available without interruption
• Every feature will remain permanently available
• Every device or operating-system version will remain supported
• Online services will always be error-free
• All trivia content will remain unchanged
• Every feature available on one platform will also be available on another platform

Updates may be necessary for security, compatibility, legal compliance, App Store requirements, bug fixes, or new functionality.
 

14. PRIVACY

Your use of the App is also governed by the Mr. Baldman Trivia Privacy Policy.

The Privacy Policy explains how information is collected, used, stored, disclosed, and protected in connection with the App.

A link to the Privacy Policy is available within the App and on the Mr. Baldman website.
 

15. CHILDREN AND MINORS

The App is intended for a general audience.

If you are under the age at which you may legally agree to these Terms in your jurisdiction, you should use the App only with the permission and supervision of a parent or legal guardian.

Parents and guardians are responsible for supervising purchases made by minors through devices or app-store accounts under their control.
 

16. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

WE DO NOT WARRANT THAT THE APP WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, COMPLETELY ACCURATE, SECURE, OR AVAILABLE ON EVERY DEVICE.

NOTHING IN THESE TERMS EXCLUDES ANY WARRANTY, RIGHT, OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED UNDER APPLICABLE CONSUMER-PROTECTION LAW.
 

17. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MR. BALDMAN AND ITS OWNER, OPERATORS, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, LOSS OF GAME PROGRESS, DIGITAL ITEMS, STATISTICS, DATA, ACCESS, OR OTHER INTANGIBLE LOSSES RESULTING FROM TECHNICAL FAILURE, DEVICE FAILURE, THIRD-PARTY SERVICES, UNAUTHORIZED ACCESS, OR OTHER EVENTS.

Nothing in these Terms limits liability where such limitation is prohibited by law.
 

18. TERMINATION

You may stop using the App at any time.

We may suspend or terminate access to some or all App services if you materially violate these Terms, engage in fraud or abuse, compromise the security or integrity of the App, or where suspension is reasonably necessary to comply with law.

Termination of App access does not automatically cancel an active app-store subscription. Subscription cancellation must be completed through the applicable app-store subscription-management system.
 

19. GOVERNING LAW

These Terms are governed by the laws of the State of Illinois and applicable United States federal law, without regard to conflict-of-law principles, except where the laws of your jurisdiction provide mandatory consumer rights that cannot legally be waived.
 

Nothing in these Terms limits rights you may have under mandatory consumer-protection laws applicable to you.
 

20. APPLE-SPECIFIC TERMS

If you download or use Mr. Baldman Trivia through Apple's App Store, your use of the App is also subject to Apple's applicable App Store terms, usage rules, and Standard End User License Agreement (“Apple Standard EULA”).

These Terms supplement, rather than replace, Apple's Standard EULA. If a provision of these Terms conflicts with a mandatory provision of Apple's applicable terms or Standard EULA, the applicable Apple provision will control to the extent of that conflict.

You acknowledge that Apple is not responsible for operating, maintaining, or supporting Mr. Baldman Trivia.

Purchases and subscriptions made through Apple's App Store are processed through your Apple account and are subject to Apple's applicable payment and subscription terms.
 

21. GOOGLE PLAY-SPECIFIC TERMS

If you download or use Mr. Baldman Trivia through Google Play, your use of the App is also subject to applicable Google Play terms and policies.

Purchases and subscriptions made through Google Play are processed through your Google Play account and are subject to Google's applicable payment and subscription terms.
 

22. CHANGES TO THESE TERMS

We may update these Terms when necessary to reflect:

• Changes to the App
• New features
• Changes to subscriptions or digital products
• Legal or regulatory requirements
• App-store requirements
• Security or operational changes

When material changes are made, the effective date at the top of these Terms will be updated.

Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

24. ENTIRE AGREEMENT

These Terms, together with the Mr. Baldman Trivia Privacy Policy and any applicable app-store terms, constitute the agreement governing your use of Mr. Baldman Trivia.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect.
